Tenth Amendment
The Tenth Amendment to the United States Constitution:
"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
IMO, this is one of the most ignored amendments in the history of the United States. Just look at some of the events in our nation's history in light of this amendment...the Civil War, for instance. I think this lays out State's Rights pretty plainly...
Imagine how much money, hassle, and corruption could be avoided if we still operated as a nation according to this amendment. "Big Government" is totally unconstitutional!

Well, first off, when you mention the civil war, what do you mean with that? Are you saying that the southern states were right to do as they did? Or that they had the right idea, but for the wrong reason? With the civil war, the government tried to right a wrong that was being done to other people. yes, at the time, slavery was allowed by the constitution, and it was a power of the state, but it was a harming power.
Also, we do still operate under this amendment. some taxes, many laws, and regulations and items of this nature are still determined by the state. the Government has a large hold over the states, but that hold keeps us together, and helps to keep us strong.
Yes, the government has taken a lot of the power that was the states right, as it was not denied in the constitution, but there are also powers that is reserved solely for the states. This amendment is hardly forgotten, rather it is used to further the governments hold on us. Also, i don't think that a big government is unconstitutional, but rather what the government does with he powers that is give to the states that is unconstitutional.
And really, i doubt that we would have avoided hassle, but rather we might just make more!

The southern states were within their Constitutional rights to do as they did.
And in case you haven't heard this before, I just wanted to let you know...slavery did not cause the war. The war was over State's Rights, which is precisely what this amendment addresses. The whole slavery excuse was used by the Union to cover up what they were really trying to do, which was strengthen the Federal government's power and influence over the states and the people.
And just because the states still retain some powers and influence does NOT mean that we are still as a country abiding by this amendment. Amendment X specifically states that any powers not delegated to the Federal government DO NOT BELONG to the Federal government, which means if they want more power, THEY CAN'T HAVE IT!
